All orders for Products placed by Customer are subject to acceptance by VPS, and no order will be deemed to have been accepted by us unless Products are supplied or a back-order or delivery delay is confirmed in writing by an authorised representative of VPS to Customer.

 

VPS may reject any order placed by Customer if there is an insufficient supply of Products which prevents us from being able to fulfil such orders.

 

VPS will not be bound by any terms attaching to Customer’s order, and unless those terms are expressly agreed to in writing by an authorised representative of VPS, Customer agrees that those terms are hereby excluded.

Acceptance of these ideas & drawings and subsequent works resulting from the use of these drawings is subject to the following conditions: The information contained within these designs is classified as concept only and Virtual Pool Store or its directors or any business owned by Virtual Pool Store cannot be held liable in any way and also can in no way be responsible for the way the design is executed. Any site conditions, which require special attention, will be the sole responsibility of the owner of that site. The design is a concept only and if council or government regulations differ from what is drawn, the owner must take full responsibility for complying to those regulations and in no way hold Virtual Pool Store or its directors or any business owned by Virtual Pool Store responsible for any charges or costs relating to the changes. All sizes should be confirmed with your nominated builder before construction begins. Some items included in the design could need specific engineer designs, which you may need to organize with an engineer of your choice in your local area, at your cost. Any contractors/suppliers chosen because of Virtual Pool Store or its directors or any business owned by Virtual Pool Store suggestions either personally or from our advertising or promotional material will be the owner's responsibility, and Virtual Pool Store or its directors or any business owned by Virtual Pool Store cannot be held liable in any way for you choosing of a certain contractor/supplier or for the supervision of any such contractor/supplier. We reserve the right to change and update the designs at our discretion without notice to users. All images and information shown on the website remain the full property of Virtual Pool Store. It is a condition of access to this site that users must not at any time use or reproduce any of the trade marks that appear, use the material or distribute or reproduce the material without written permission from Virtual Pool Store. Virtual Pool Store through it's Accredited Builder Program, does not hold itself out as agents or otherwise of the advertised pool builders. The purchasor will be fully responsible for entering into a contract with the chosen pool builder to deliver the construction, landscaping or other services.

The designs, specifications and overall concepts, either wholly or in part, remain the property of Virtual Pool Store. These works may not be copied or used by any persons without the written authority of Virtual Pool Store. The copyright and all other intellectual property rights in all material on this site are held by or licensed to Virtual Pool Store unless otherwise stated. All rights in all texts, images and materials appearing in this site are reserved. You may read and download certain materials (in their entirety) for personal use only, on condition that you comply with the terms and conditions applicable to this site. You may not alter any material, repost or sell it without prior permission. Commercial use or publication of all or any material displayed, without prior written permission from Virtual Pool Store, is strictly prohibited. Should the copyright of these works be infringed, Virtual Pool Store may take action at law or in equity to protect its interests. Designs cannot be used for multiple sites and a new design package must be purchased for each site address.

Virtual Pool Store offer an unconditional 30 Day Money Back Guarantee. If, for any reason, you are not satisfied with the design you have purchased, you may ask for a full refund. This guarantee is valid for 30 days from the day you purchased the design. In the event that a purchase is refunded, the design in electronic or printed form must be destroyed. Any use of the design after a refund is requested or given, is in breach of these terms and conditions. Virtual Pool Store reserves the right to initiate a transaction to any purchaser if that purchaser is deemed to have utilised the materials in any form.

When you purchase a VPS Pool Design Package it will be delivered to an email address nominated by you as soon as, or soon after, your payment is approved. You may select to receive the final package in either Printed or Electronic Format. Additional charges will apply for packages supplied in hard-copy.
